Service Terms & Conditions
These Service Terms outline how billing, carts, pickups, and responsibilities work with ICT Trash Service LLC. By using our residential trash service, you agree to the terms below.
1. Billing & Payment Terms
Residential trash service is billed in advance on a billing schedule (monthly, quarterly, or annually) chosen at sign-up. Invoices may be sent by email, mail, or online billing system.
1.1 Due date & late fees
All invoices are due by the due date printed on the invoice. Any invoice not paid by the due date is considered past due.
A $5 late fee is applied to any invoice not paid by the due date.
1.2 Suspension & reactivation
Accounts that are 10 days past due may be placed on temporary service suspension. While the account is suspended:
- Trash will not be collected until the past due balance is paid in full.
- Billing and your normal service cycle continue; time is not prorated for missed service during a suspension.
A $25 reactivation fee will be charged to restore service after suspension. Once reactivated, all trash accumulated during the suspension will be collected on your next regularly scheduled pickup.
1.3 Forms of payment
Accepted payment methods include online payment via ACH/bank draft (preferred), debit card, Google Pay, Apple Pay, credit card (credit card may have a 3% processing fee) or check by mail. Returned checks are subject to a $15 returned check fee.
2. Trash Carts & Property of ICT Trash
All trash carts provided to customers remain the property of ICT Trash Service LLC and must remain at the service address at all times.
2.1 Customer responsibility
You agree to:
- Use the cart only for household trash that is allowed under these terms.
- Keep the cart reasonably clean and free from paint, markings, or permanent alterations.
- Ensure the cart is not intentionally damaged, burned, or abused.
- Make sure the cart is accessible on service day (not blocked by vehicles, trailers, or other obstructions).
2.2 Damage, loss, or theft
Normal wear and tear from regular use is covered by ICT Trash. However:
- Damage caused by misuse, fire/ashes, prohibited chemicals, or negligence may result in a replacement cart fee.
- Lost or stolen carts must be reported promptly. Replacement fees may apply depending on the circumstances.
3. Service Guidelines
3.1 Set-out time & placement
Carts must be placed at the curb or designated collection area by 5:00 AM on your scheduled service day. To ensure safe and efficient pickup:
- Place the cart within 3 feet of the curb or roadway.
- Face the cart with the handles toward the house and lid opening toward the street (if applicable).
- Keep at least 3 feet of clearance around the cart from mailboxes, vehicles, and other obstacles.
Carts set out after the truck has passed may not be collected and are considered a late set-out. No credit is issued for late set-out.
3.2 Missed collection
If we are unable to collect your trash due to blocked access, unsafe conditions, late set-out, or overloaded/prohibited materials, it may be considered a non-serviceable stop and no credit is issued.
If ICT Trash misses a pickup in error, we will either return as soon as reasonably possible or apply a service adjustment at our discretion.
3.3 Extra trash
Extra bags or loose trash outside the cart may incur additional charges unless approved in advance. Please contact us for special pickups or large clean-outs.
If your account is suspended for non-payment, any trash accumulated during that suspension period will be collected on the next pickup after full payment and reactivation. Note: Time is not prorated for suspension days.
4. Prohibited Items
For the safety of our drivers, equipment, and the environment, the following items must not be placed in the trash cart:
- Concrete, dirt, rocks, bricks, or construction debris.
- Hot ashes or coals.
- Hazardous waste (chemicals, oils, fuels, solvents, antifreeze, pesticides, etc.).
- Wet paint, solvents, or other liquid waste.
- Car batteries or large rechargeable batteries OR ANY OTHER BATTERIES!
- Medical waste or biohazard materials.
- Large scrap metal, engines, or equipment parts.
- Tires or large automotive parts.
- Appliances.
- Dead animals.
- Fluorescent bulbs or items containing mercury, where prohibited.
- Any item restricted by local, state, or federal law.
If prohibited items are found in your cart, we may refuse collection, charge additional handling fees, or require corrective action before service resumes.
5. Driveway & Property Damage Disclaimer
Our trucks and equipment are heavy and may travel on streets, alleys, and occasionally private drives. While reasonable care is taken, ICT Trash Service LLC is not responsible for:
- Cracks, breaks, or damage to driveways, curbs, or pavement from weight of trucks or carts.
- Tire ruts or tracks in yards, gravel, or soft surfaces.
- Scratches, scuffs, or marks on surfaces caused by normal cart movement.
- Damage caused by improper placement of carts by the customer.
- Damage caused by weather conditions such as mud, ice, or snow.
Customers are encouraged to place carts on the street, up against the curb, or at least UP TO the street edge in areas that minimize risk to landscaping and hard surfaces.
6. Service Changes, Moving & Cancelation
6.1 Rate and policy changes
ICT Trash may update service rates, fees, or these terms from time to time. We will provide notice of material changes by reasonable means, which may include email, invoice notes, website updates, or mailed notices.
6.2 Moving
If you move, you agree to contact us prior to your move-out date so we can:
- Update your service address (if moving within our service area), and/or
- Schedule retrieval of ICT Trash carts from your old address.
Carts must not be moved to a new location without our approval.
6.3 Cancelation
You may cancel service by contacting ICT Trash directly. Carts must be left out on the agreed date for pickup and retrieval. A cart pickup fee of $25 may occur. Missing or damaged carts may incur replacement or repair fees.
7. Severe Weather & Holiday Schedule
7.1 Weather delays
Service may be delayed, postponed, or canceled due to severe weather, unsafe road conditions, flooding, heavy ice, or other hazards. When this happens, we will adjust the route schedule as safely and reasonably as possible.
Weather delays do not typically result in credits; collected volume is made up on the adjusted date.
7.2 Holidays
Certain holidays may affect service days. Holidays that fall on a weekday are picked up 1 day late, and the rest of the same week schedule is 1 day later also. 8. Liability Limitations & Agreement to Terms
ICT Trash Service LLC is not liable for:
- Loss of items that were accidentally placed in the trash or cart.
- Damage or loss to items placed near the cart or curb intended to be kept.
- Service interruptions or delays caused by conditions beyond our control (weather, road closures, accidents, etc.).
- Injury or damage resulting from improper use or handling of carts by the customer or third parties.
By enrolling in or continuing residential trash service with ICT Trash Service LLC, you acknowledge that you have read, understand, and agree to these Service Terms, including our billing practices, late fees, suspension and reactivation policies, cart ownership rules, and limitations of liability.
These terms are intended as a general guideline for residential service. ICT Trash Service LLC reserves the right to make reasonable exceptions or adjustments on a case-by-case basis.
